摘要
以十八届四中全会明确党内法规的法律地位为开端,伴随着新时期全面依法治国与全面从严治党实践的深入推进,党内监督法规与国家法律制度的衔接命题得以真正发生。在顶层制度设计领域,综合立法理念、制度设计以及实施原则的考量评判,《中国共产党党内监督条例》与《中华人民共和国监察法》是新时期党规国法监督制度衔接的一个颇具借鉴意义的成功范例。党规国法监督制度衔接推进理应在两个层面展开,理念层面必须坚持党的领导地位,围绕反腐败工作核心展开;制度层面则需要在立法沟通、协同审查、整合解释方面推进系统化制度衔接改革。党规国法监督监察制度衔接的理想目标应该是围绕共同目标任务,发挥各自制度特色、吸收对方制度优势,在坚守与借鉴中成功打造党规国法监督衔接的制度合力。
The discussion over the connection of inner-party supervision regulations and the national legal system really began only after the fourth plenary session of the 18 th Party Central Committee established the inner-party regulations’ legal status accompanied by the deepening of practice in over-all rule of law and strict governance of the Party. In the realm of top-level institutional design,judged by examining the principles of legislation,institutional design,and implementation,The CPC Regulations on Internal Supervision and The Supervision Law of the People’s Republic of China are a good example of connecting Party regulations and the national laws in the new era in the area of supervision. The connection should be realized at two levels. At the conceptual level,we must adhere to the leading position of the Party while focusing on anti-corruption work;at the institutional level,we should promote reforms in systematic institutional connection in aspects such as legislative communication,collaborative case review,and unified interpretation. The ideal objective of connections between party regulations and national laws as well as supervision and inspections should center around common goals and tasks,combine each other’s characteristics and institutional advantages,and join the forces of the two.
