我国高危险性体育项目行政许可条件设置的完善--基于现行法律文本的考察

The Perfection of the Setting of Administrative Licensing Conditions for High-risk Sports in China--Based on the Investigation of the Current Legal Text

高危险性体育项目是相对一般体育项目而言,危险性比较大、技术要求相对复杂的体育活动。设置高危险性体育项目的行政许可条件的法理基础是基于生命健康权以及行政特许经营权理论;目的是限制准入、强化管理以及警示风险。我国现有关于高危险性体育项目行政许可条件的设置存在如下不足:经营主体资格不统一;经营客体的范围有大小;体育设施标准不一致;技术人员要求不同等;我国需要在经营主体、经营客体、专业人员的要求、体育设施标准等方面规范设置现行高危险性体育项目的行政许可条件,以有效促进我国高危险性体育运动项目的开展与发展。

The high-risk sports refer to such sports activities which are relatively dangerous and technically complex compared with the general sports.The legal basis of setting the administrative licensing conditions for high-risk sports is based on the rights of life and health and the theory of administrative franchise right.The aim is to limit access,strengthen management and warn risks.The current setting of administrative licensing conditions for high-risk sports projects in China has the following deficiencies:Inconsistent qualifications of operators;the scope of business object is not uniform;inconsistent standards of sports facilities;different requirements of technical personnel and so on.In order to effectively promote the conduction and development of high-risk sports in China,administrative licensing conditions of high-risk sports items and guarantee the development of high-risk sports items in China.China needs to unify and standardize the current administrative licensing conditions for high-risk sports in terms of business subjects,business objects,requirements for professional personnel and standards of sports facilities.
