摘要
土地发展权是一项具有动态、立体和增量意涵的新型土地用益物权。在土地开发利用关系的调整时点与权利内涵上,土地发展权与其他土地用益物权之间存在一定区隔性。在权利来源上,土地发展权也是从土地所有权中分离出来的,与其他土地用益物权及其构成的体系间具有兼容性。将土地发展权纳入我国土地用益物权体系符合民事物权生成与发展的规律,具体路径上,须明确土地发展权的入法方式与权利构造,在此基础上协调静态土地物权和动态土地权利的运行。
Land development right is a new type of land usufructuary rights with dynamic,dimensional and incremental meaning.As to the timing of adjustment and the connotation of rights in the relationship between land development and use,there is a certain distinction between land development rights and other land use rights.From the source of the right,the land development right is also separated from the land ownership and is compatible with other land usufructs and its constitution system.Incorporating land development rights into China's land usufructuary property rights system is in line with the rule of law in the formation and development of civil property rights.The specific path should clarify the law entry mode and the structure of land development right,and on this basis,coordinate the operation of static land real right and dynamic land right.
