摘要
行政规制与司法规制是金融风险防范的两种路径,我国更倾向于行政规制,而忽略司法规制。现阶段,金融司法规制侧重于争议纠纷解决,且行政主导化倾向明显,应从政策、机构以及技术等角度予以完善,构筑金融风险司法规制的三维空间,充分发挥司法机关创制金融公共政策职能,通过设立金融法院(巡回法院)或金融法庭、推进(金融)消费公益诉讼等措施,强化金融风险的有效识别和防范化解。
Administrative and judicial regulation are two ways to prevent?financial risk.China prefers administrative regulation but?ignores judicial regulation.At the present stage,financial judicial regulation focuses on settling dispute,and the tendency of administrative dominance is obvious.It should be improved from policies,organizations,and technology?to build a three-dimensional space for judicial financial risk?regulation.Specifically,the judiciary should give full play to the functions of creating financial public policies,and establish Financial courts(tour courts)or financial courts,promotion(financial)consumer public interest litigation and other measures to effectively identify and prevent financial risks.
