乡村振兴战略中农地经营权入股问题探究--以优化农业营商环境的法律服务为视角

营商环境是影响市场主体行为的一系列综合发展环境的总和,是市场与政府、社会相互作用的结果,而提升法律服务的精准度是优化营商环境的有效手段。在乡村层面,则是在乡村振兴战略指引下,通过法律介入,理顺农业生产关系,解放农村生产力,以推动三农问题的解决,而农地经营权入股问题则是发展进程中面临的重要课题。实践中,农地经营权入股长期徘徊于初级阶段,未能完全实现三权分置的理论预设,其原因在于现行农地立法尚以土地承包经营权为中心,农地经营权的立法规制与配套措施还不完善。创设农地经营权入股的登记生效制度、选择合理的与农地经营权入股兼容的辅助制度、加强对入股农地农业用途的监管,是规范农地经营权入股的有效手段,也是将乡村振兴战略导向深入、优化农业营商环境的重要举措。

Business environment is the sum of a series of comprehensive development environments that affect the behavior of market participants and the result of interaction between market,government and society.Improving the accuracy of legal services is an effective means to optimize business environment.At the rural level,under the guidance of the rural revitalization strategy,through legal intervention,rationalizing agricultural production relations,liberating rural productivity,to promote the solution of three rural issues,while the issue of Shareholding of agricultural land management is an important issue in the development process.In practice,the Shareholding of farmland management has been hovering in the primary stage for a long time,and the theoretical presupposition of the separation of the three powers has not been fully realized.The reason lies in the fact that the current farmland legislation is still centered on the right to contractual management of land,and the legislative regulation and supporting measures of the Shareholding of farmland management are not perfect.Establishment of effective registration system,the selection of a reasonable auxiliary system compatible with the Shareholding to farmland management,and the strengthening of supervision over the use of the Shareholding in farmland are effective means to regulate the Shareholding of farmland management,as well as important measures to guide the strategy of rural revitalization and optimize the environment of agricultural business.
