中国自贸试验区征信法治体系建设问题研究

Research on the Construction of Legal System of Credit Investigation in China Pilot Free Trade Zone

社会信用体系同具体领域的征信法治体系建设具有二元互动性,而自由贸易领域的征信法治体系建设又具有自身特点。完善相应的征信法治体系建设,应在考虑传统信息安全、数据评估等问题的基础上,以破除贸易阻碍、推动贸易公平、提高贸易效率、维护贸易秩序为重要原则,促进自贸试验区整体征信水平的有效提升。基于贸易参与者视角,应当制定科学有效的征信市场发展规划,同时结合自贸试验区的特点与任务,加快推进自由贸易征信监管机制与征信奖惩机制建设,运用清单及信用修复等多元手段,构建完善的自贸试验区征信法律治理体系,切实保障区内贸易参与者的征信权益,最终实现自贸试验区平台高效贸易功能的发挥。

The social credit system has dual interaction with the legal system of credit investigation in specific fields,while the legal system of credit investigation in the field of free trade has its own characteristics.In order to improve the construction of the corresponding legal system of credit investigation,we should,on the basis of considering the traditional information security,data evaluation and other issues,take removing trade barriers,promoting trade fairness,improving trade efficiency and maintaining trade order as the important principles,and promote the effective improvement of the overall credit investigation of China pilot free trade zone.Based on trade participants view,we should make scientific and effective credit market development plan;Meanwhile,according to the characteristics and tasks of the free trade area,we should accelerate the improvement of free trade credit supervision mechanism and credit rewards and punishment mechanism,build a perfect legal system of governance in the free trade zone by using multiple means such as checklists and credit repair,effectively protect the credit rights and interests of the participants in the area,so as to better develop the function of experimental platform for efficient trade.
