推行环境责任保险法律制度面临的困境与出路

随着我国经济的蓬勃发展,环境污染问题日渐突出,给经济的可持续发展带来难以估量的损失,而环境责任保险就是针对这一现象并有效解决这一问题的重要机制。环境责任保险试点工作在我国已经试行多年,但由于法律不健全、缺乏相关法律规定、企业不积极等原因,这项工作发展缓慢。这就需要我们立足社会发展实际,通过完善环境责任保险法律制度的立法体系、建立健全相关配套制度、强化环境污染责任的追责等措施,为我国环境责任保险平稳发展奠定坚实的基础,最终为解决我国环保问题提供有力的保障。

With the vigorous development of China′ s economy, the problem of environmental pollution is becoming more and more prominent, which has caused incalculable losses for the sustainable development of the economy, and environmental liability insurance is an important mechanism to solve this problem effectively. However, although the pilot work of environmental liability insurance has been tried for many years, it has been slow due to legal imperfection and lack of legal provisions, inactive enterprises and so on. Therefore, it is necessary to improve the legal system of environmental liability insurance legislation on the basis of the reality of social development, to establish and improve the relevant supporting system and strengthen the responsibility for environmental pollution liability and other measures so as to lay a solid foundation for the smooth development of China’s environmental liability insurance and ultimately provide a strong guarantee to solve China’s environmental protection problems.
