二次碾压型交通肇事案件疑难问题研究——以类型化处理为研究视角

Study on Difficult Problems of Second Rolling in Traffic Accidents——From the Perspective of Typological Processing

许多二次碾压型交通事故被害人的具体死亡时间难以分清,导致交通事故责任难以准确划分。刑事司法中对交通管理部门出具交通事故认定书采取实质审查态度,导致实践中对该类案件处理差异较大,甚至出现对前后两次交通肇事者均无法认定犯罪的情形。实际上,二次碾压型交通肇事情况多样,情况不同,归责结果也不同。因此,应分析影响定罪的关键因素,根据被害人死亡时间、前后行为人的事故责任情况、是否具有逃逸情节将二次碾压型交通事故进行分类处理。

It is difficult to affirm the liability of traffic accidents due to the inability to determine the death time of the victims in the second rolling of traffic accidents.Judicial authorities take a substantive review attitude towards Certification of liability for traffic accidents issued by the traffic management department.In fact,the cases of second rolling in traffic accidents are various,and different situations lead to different imputation results including the case in which the troublemaker′s crime in both the first and second rolling cannot be affirmed.The key factors in dealing with the crime of the second rolling consists of the time of the victim′s death,the accident liability,and the intended escaping.By analyzing these factors,we can classify and deal with those accidents.
