率先建立与国际运行规则相衔接的上海自贸试验区制度体系

Being the first to Establisha Institutional System of Shanghai’s Free Trade Pilot Zone in Line With International Operation Rules

上海自贸试验区对接国际经贸规则的难点在于需要国家权力的重新配置,而以往的改革创新更多聚焦于地方权力层面。未来上海自贸试验区与国际经贸规则的对接,应从目前的“调法路径”转向“创法路径”,或提请国务院“综合赋权”,以增设上海自贸试验区新片区为契机,在实施部分产品零关税,制定准确的负面清单,试点数字跨境流动,进一步开放金融、教育、医疗领域等方面率先对接。

The difficulty for Shanghai free trade experimental zone to connect with international economic and trade rules lies in the need for reallocation of state power,while previous reforms and innovations have focused more on the level of local power.In the future,the connection between the Shanghai FTZ and international economic and trade rules should be changed from the current“regulatory approach”to the“law-creating approach”,or the State Council should be requested to“comprehensively empower”and take the opportunity of adding new areas in the Shanghai FTZ to implement zero tariffs on some products,draw up accurate negative lists,pilot digital cross-border flows,and further open up the financial,educational and medical fields to take the lead in the connection.
