监察信息公开范围初探

A Preliminary Exploration of the Scope of Supervision Information Disclosure

国家监察体制改革以后,需要制定专门的监察法规,其中监察信息公开的范围是核心内容之一。监督信息公开应遵循“以公开为常态,不公开为例外”的原则;结合监察法的特殊性,还应坚持依法公开、诚实信用、比例平衡原则。参照党务公开、政府信息公开、司法公开的范围,依据我国监察机关的职权内容,可采取肯定列举加详列豁免范围的模式对监察信息公开范围进行立法。

After the reform of the national supervision system,previous laws and regulations cannot apply to the disclosure of supervision information,and specialized supervision laws and regulations need to be formulated.The scope of supervision information disclosure is the core of the specialized laws and regulations.On October 26,2019,the State Supervisory Committee obtained the power to formulate supervision laws and regulations.With reference to the scope of disclosing party affairs,government information and judicial proceedings,based on the duties of China’s supervisory authorities,a positive enumeration plus a detailed list of exemption scope can be adopted to legislate the scope of supervision information disclosure.
