“价值-利益-权利”:公众参与公共政策制定的行为逻辑--基于《北京市生活垃圾管理条例》的出台过程解读

“Value-Interest-Right”:The Behavior Logic of the Public Participation in Public Policy Formulation

从政策网络的视域解读多元主体博弈合作下的公共政策制定过程,借由《北京市生活垃圾管理条例》的出台探析公众参与公共政策制定的行为逻辑,以建立对公众参政现象的深度微观理解。利用政策网络理论,具体分析博弈事件中的利益相关者的行动策略及其行为互动对政策出台产生的影响,得出具有不同价值理念、利益诉求和权利禀赋的多元行动者搭建的网络平台是该政策出台的最大推力,"价值-利益-权利"三角链条的互构作用主导着政策网络主体的行动逻辑。通过对案例的探讨以期为公众参与公共政策制定提供有效途径,为学界运用多中心治理理论提供典型范例,为政府解决类似公共事件提供有效借鉴。

This article interprets public policy making process promoted by multi-subject cooperation and interaction from policy network perspective,exploring the behavior logical of the public participation in public policy making by the introduction of Beijing household waste management regulations,in order to establish deep understanding of public political participation behavior from micro perspective.Investigating the impact of stakeholders’ action strategy and its interaction to policy promulgation by policy network theory,we conclude that policy network platform constructed by multiple actors who uphold different values,interest appealing and right states is the maximum thrust to the policy promulgation,"Value-Interest-Right" triangle chain and its mutual constitutive function dominates the action logic of policy network actors.Discussing this case can provide effective way for public participation in policy formulation,provide typical example for academia in terms of using multi-center governance theory and offer effective reference for the government in terms of handling similar public events.
