竞争中立视角下中国企业海外投资风险防范

Risk Prevention of Overseas Investment of Chinese Enterprises in the View of Competition Neutrality

2011年,美国国务院副国务卿罗伯特•霍马茨(Robert Hormats)多次在外交场合提及“竞争中立”(competitive neutrality)的概念,近年来"竞争中立"也逐渐被大多数国家所认可与采纳,并表现于多个双边和多边贸易协定之中,且有发展成为新的国际经济规则的趋势。中国作为海外投资大国,海外并购项目正不断从传统的资源能源领域向多个领域拓展,这要求中国必须密切关注国际环境、国际规则的变化,提高认识、积极应对,以减少我国在对外投资过程中可能面临的不利因素,以维护自身利益。

In 2011,Secretary of State Robert Hormats mentioned the concept of"competitive neutrality"on diplomatic occasions for many times.In recent years,the concept of"competitive neutrality"has been gradually recognized and adopted by most countries,which is manifested in many bilateral multilateral trade agreements,and has developed into new international economic rules.As a big country of overseas investment,China's overseas M&A projects are constantly spreading from the traditional resource and energyt fields to many fields,which requires China to pay close attention to the changes in the international environment and international rules,improve awareness and actively respond to them,so as to reduce the possible adverse effects China may face in the process of foreign investment and maintain its own interests.
