法理学实验研究的兴起与中国法理学观念的更新

用认知科学的实验方法研究法律问题是近年来的学术亮点,值得学界关注。法理学实验研究的出现可被归因于三点原因:其一为对既往法学研究尤其是分析法学研究之局限的理性反思,其二为实验哲学的智识支撑,其三为认知神经科学、人工智能和互联网技术的推动。法理学实验研究的出现必将为法理学研究带来积极影响。一方面,法理学实验研究为法理学的方法论提供了新思路,拓宽了法理学研究的论域,其是将科学哲学、法律科学和法律哲学这三门独立的学科进行结合的一种尝试。另一方面,法理学实验研究有利于科学家型法学家的产生,其为进一步祛除法学精英主义取向、健全法学研究提供了有力的证据。当代中国法理学正致力于复兴一种"对法理的共同关注",法理学实验研究无疑有利于更新中国法理学研究的观念。当然,实验法理学作为新事物,仍然存在一些问题需要尽力克服。

In recent years, it is an academic highlight to study legal issues with the experimental method of cognitive science, which deserves the attention of the academic community. The emergence of experimental jurisprudence can not only be attributed to the previous legal research, especially the rational reflection on the limitations of the analytical jurisprudence, but also to the intellectual support of experimental philosophy, as well as the triple promotion of cognitive neuroscience, artificial intelligence and Internet technology, which will certainly bring positive impact on the study of jurisprudence. On the one hand, experimental jurisprudence provides new ideas for the methodology of jurisprudence and broadens the research field of jurisprudence, and is an attempt to combine the three independent disciplines of philosophy of science, legal theory and philosophy of law. On the other hand, experimental jurisprudence has led to the emergence of scientists-type jurists and has also provided strong evidence for further eliminating the orientation of legal elitism and perfecting the legal research. Contemporary Chinese jurisprudence is committed to reviving a"common concern of Fali", which is undoubtedly conducive to the formation of the enlightenment of the experimental study of Chinese jurisprudence. Of course, as a new thing, experimental jurisprudence still has some problems to overcome.
