摘要
督查是我国国家治理体系中的一项特色制度和实践。当前我国督查工作实践颇丰,治理效果显著。但是督查过多,督查“形式主义”、“官僚主义”等,直接导致基层单位工作负担加重。督查工作缺乏法律依据的问题较为突出。督查工作需要不断进行制度完善,应从以下方面将之纳入法治轨道:明确督查兼具政治性和法律性;合理定位督查功能;建立督查法律规范体系;限定督查权主体范围;明确督查程序和效力;在划定督查职权边界的同时,注重构建科学、权威的督查统筹协调机制。
Supervision is a unique arrangement and practice in our country’s national governance system. At present, China’s supervision practices are rich, and the governance effect is remarkable. However, problems such as excessive supervision, formalism and bureaucracy directly lead to the increased work burden of the lower-level institutions. The lack of legal basis for supervision is prominent. The supervision work need to improve institutionally and should be made law-based in the following areas: clarifying the political and legal nature of supervision;reasonably defining the function of supervision;establishing the legal and regulatory system for supervision;limiting the scope of people exercising supervision powers;making clear the supervision procedure and effectiveness;and prescribing the supervision powers and functions, while paying attention to creating a scientific and authoritative supervision coordination mechanism.
