反不正当竞争地方立法疑难问题及其立法建议——以湖南省反不正当竞争地方立法问题为例

Questions and Suggestions on Local Legislation of Anti Unfair Competition——Examples for the Anti Unfair competition of Hunan Province

反不正当竞争法自颁布施行至今,其立法体系形式上已相对完善,但仍有必要优化:一方面,处于该立法体系中的上位法《反不正当竞争法》部分条款可操作性仍有待进一步增强;另一方面,处于该立法体系中的下位法反不正当竞争地方立在部分地区尚未制定,影响并阻碍反不正当竞争法律适用效果。在遵循基本地方立法规范前提下因地制宜制定反不正当竞争地方立法确有必要。湖南省反不正当竞争法律适用在统一执法权界定、相关管辖权划分、某些具体行为认定、处罚标准自由裁量等问题上仍存在适用困境,亟需通过制定反不正当竞争地方立法增强其可操作性以适应地方治理现实需求。具体而言,其制定共涉及立法规范包含18个方面共计30多个具体问题,其中涉及相对方存在的问题和解决问题的措施有7个方面,涉及管理方存在的问题及解决问题的措施有11个方面。

From the first modification of Anti Unfair competition law,the legislative system can be complete,but it is stil not perfect.Firstly,some terms of Anti Unfair competition law can not be carried out;secondly,parts of our country still do not have the local legislation of Anti Unfair competition law,it blocks the use of Anti Unfair competition law.So we have to make the local legislation of Anti Unfair competition law.The local legislation on Anti Unfair competition on Hunan Province still has the problems,just like the definition of uniform law enforcement power,like the division of jurisdiction,like the concrete action cognizance,like the standard of punishment,and so on.Badly in need,we have to take the Local legislation of Anti Unfair competition law in Hunan Province.Specifically,it involves eighteen aspects about thirty problems.The questions on consumers will be seven,The questions about managers will be eleven.
