乡村振兴战略下的农业再保险法律制度研究

Legal System of Agricultural Reinsurance under Rural Revitalization Strategy

阐述了我国目前农业再保险法律制度的现状,分析了我国农业再保险法律制度中存在的可操作性低、农业再保险经营机构自身承保能力较弱、政策和财政对行业支持力度不够以及行业积极性不足等问题,通过对中外农业再保险制度的比较研究及对域外成熟经验的学习借鉴,提出了优化农业再保险制度的顶层设计,采用合并立法模式,及时总结试点经验提炼制度内容,加大政府税收优惠、考虑设立专项基金,组建农业再保险公司,明确农业再保险行业监管主体等对策建议,以保障农业生产稳定性,实现乡村振兴发展的战略性目标。

The present situation of Chinese agricultural reinsurance legal system was expounded.The Problems such as low operability,weak underwriting capacity of agricultural reinsurance operating institutions,insufficient policy and financial support for the industry,and insufficient enthusiasm for the industry were analyzed.By the comparative study of Chinese and foreign agricultural reinsurance system and the mature experience to learn from outside,the top design for the optimization of agricultural reinsurance system was put forward to ensure the stability of agricultural production,achieve the strategic objectives of the development of rural revitalization,including adopting merger legislation pattern,summing up the experiences of pilot extraction system in a timely manner,increasing the government tax incentives,setting up special funds,establishing agricultural reinsurance companies,clearing agricultural reinsurance industry supervision main body’s suggestion.
