Guarantor's Rights and their Remedies

随着我国市场经济的迅猛发展,各经济主体之间的借贷交易时有发生,这也就促进了保证制度的产生与发展。保证制度对现代经济的发展具有极大的推动作用,其可以推进金融发展,促进交易从而最终活跃市场经济。而保证人在保证制度中就占据着举足轻重的地位,保证人在拥有一些权利的同时也承担着较大的风险和义务,然而现行的担保法律体系对保证人权利的维护缺乏必要的关注,这导致在大多数时候保证人承担的义务远远大于其所享有的权利,此时,对于保证人权利的救济就显得至关重要,因此,介绍保证人的各项权利并提出对其权利的救济的行之有效的方式,从两个方面探讨保证人的权利,以期更好地维护保证人的合法权益,从根本上稳固我国的保证制度,完善我国担保法律体系。

With the rapid development of the socialist market economy in China,loans and other transactions between various economic entities occur from time to time,which also promotes the emergence and development of the guarantee system.The guarantee system has a great effect on the development of the modern economy.It can promote the development of finance,promote transactions,and eventually invigorate market economy.The guarantor occupies a pivotal position in the guarantee system,and also bears greater risks and obligations while possessing some rights.However,the current guarantee legal system of the People's Republic of China lacks the necessary attention to the protection of the guarantor's rights.This leads to the obligation of the guarantor being much greater than the rights enjoyed by the guarantor in most cases,when the remedy for the guarantor's rights becomes essential.Therefore,the purpose of this article is to introduce the rights of the guarantor and propose effective ways of remedying the rights of the guarantor.In order to better safeguard the legal rights and interests of the guarantor,we will fundamentally stabilize our country's guarantee system and improve the guarantee legal system of the People's Republic of China.To explore the rights of guarantors,two aspects can be analyzed,one is the rights of guarantors to creditors and the other is the rights of guarantors to debtors.
