送法下乡的困境与未来进路——基于H镇K村的实地调研 被引量:1

摘要 我国送法下乡研究可分为三个时期:费孝通提出的乡村社会性质与乡村秩序维系论时期,20世纪末的法律至上论时期,苏力主张的法治本土资源论时期。如今农民的价值观念、行为逻辑和联结模式都发生了质变,不仅“生于斯,长于斯,死于斯”的乡土社会发生了改变,费孝通笔下的经验传承社会也发生了变化,送法下乡已有现实需求。本研究通过对H镇K村的实地调研,发现目前我国送法下乡面临村民尊法崇法的法治意识尚未形成、较多留守村民不识字、法律解决逻辑与村民纠纷调解方式不一致等问题,问题的解决需要培养村民尊法崇法的法治意识,兴办乡村学校推行文字下乡,关注村民需求以彰显人文关怀。 Historically,China's"law education and propagation project in the countryside"can be divided into three periods:the period of rural social nature and maintenance of rural order put forward by Fei Xiaotong,the period of supremacy of law at the end of last century,and the period of local resources under the rule of law advocated by Su Li.Today,the value concept,behavior logic and connection mode of farmers are undergoing qualitative changes.Not only has the local traditional idea,"born here,growing up here and died here",changed,but also the society of experience inheritance described by Fei Xiaotong has changed,and"law education and propagation in the countryside"has already had the actual demand.At present,China's"law education and propagation project in the countryside"faces several problems,such as villagers'awareness of respecting the law and worshipping the law has not yet been formed,the phenomenon that they do not know the written language is common,and the logic of legal settlement is not unified with the mediation of disputes among villagers.This needs to be solved urgently by cultivating villagers'awareness of respecting the law and worshipping the law,setting up rural schools to promote the writing to the countryside,and paying attention to villagers'needs to show humanistic care.
