我国机构养老规制政策的发展、问题及其完善

The development,problems and perfection of institutional pension regulation policy in China

当前我国中央层面的机构养老法规政策体系虽已初步建立,但地方层面机构养老法律规制发展参差不齐。因此从机构养老准入、运营、监管三个维度,对我国机构养老规制政策进行梳理与分析。研究认为,为进一步完善我国机构养老的规制政策,应将养老服务的市场化与养老规制的法治化同步推进,明确机构养老的规制部门权限,建立跨部门协调监管制度;提高规制政策的针对性、可操作性;着重保护机构内老年人的权益;加强地方机构养老的规制政策体系建设。

At present,the institutional endowment law and policy system at the central level have been preliminarily established,while the development of institutional endowment law and regulation at the local level are uneven.Therefore,this paper analyzes China’s institutional pension regulation policies from the institutional pension access,operation and supervision.The results show that,for further improving the institutional pension regulation policy of China,we should promote the regulation policy from the marketization of the pension service and the rule of law of the pension regulation,legislation of the pension regulation,so as to clarify the authority of the regulatory department and the inter-departmental coordination and establish the supervision system for the institutional pension,make the highly targeted and operational regulatory policies,focus on the protection of the rights and interests of the elderly in institutions,and strengthen the construction of a regulatory policy system for the elderly in local institutions.
