刑事视域下智能算法的应用与反思

The Application and Reflection of Intelligent Algorithms in Criminal Perspective

就广泛受到学界关注的人工智能一事而言,智能算法是其成就及发展的必要条件。智能算法的应用与发展,归根结底具有一定的社会属性,受到社会规范和惯例所影响,无法也不能摆脱人为的控制与监管。因而智能算法具有天然的缺陷,在刑事领域中,针对这些缺陷应采取原则确定和罪名适用并举的方式,进行规范与解决。在对其进行规范时,应当容许有一定的风险,并进行严格的责任分配。基于此,笔者重点探讨了刑事视域下智能算法的应用与反思。

As far as artificial intelligence,which is widely concerned by the academic circle,intelligent algorithms are a necessary condition for its achievement and development.In the final analysis,the application and development of intelligent algorithms have certain social attributes and are affected by social norms and practices.They cannot and cannot escape human control and supervision.As a result,intelligent algorithms have natural flaws.In the criminal field,in order to address these flaws,principles should be adopted and crimes should be applied simultaneously to standardize and resolve them.In regulating them,certain risks should be tolerated,and strict responsibility allocations should be made.Based on this,the author focuses on the application and reflection of intelligent algorithm in the criminal perspective.
