摘要
在法律层面上,对于将突发公共卫生事件视为不可抗力事件适用于劳动关系的规定基本空白。面对突如其来的公共卫生事件不可抗力对劳动用工关系领域带来的不利影响,不仅要注重不可抗力在处理劳动关系纠纷程序时产生的法律后果,也要研究在现有劳动法律框架内准确适用不可抗力制度,要考虑劳动法律倾向于保护劳动者基准权益的特点,不能全面适用不可抗力民商法律规定。应在不违背相关法律规定的前提下,做到不可抗力民事制度在劳动用工关系领域的有限适用,以实现劳资关系和谐、均衡保护双方利益的目的。
On legal level,there still exits blank as to regarding public health emergencies as force majeure applicable to labor relations.For the disadvantages of the unexpected public health emergency force majeure on labor employment relations,it is not only necessary to emphasize on the legal consequences of force majeure in the process of dealing with labor disputes,but also necessary to study the proper application of force majeure system within the existing labor laws.Consideration should be taken into the characteristics of labor laws’tendency to protect workers'benchmark rights and interests,while force majeure regulated in the civil and commercial laws and regulations cannot be comprehensively applied to labor laws.Without violating the relevant laws and regulations,the civil system of force majeure should be limitedly applied to the field of labor employment relations,so as to protect the interests of both parties and achieve harmonious labor relations.
