论心理学视角下的法学研究

Study of Law from the Perspective of Psychology

法学与多门学科都有交叉,并都有很多相关研究,但与心理学的交叉研究并不多。二者的交叉研究在两百多年以来,经历低潮与和解,期间产生了彼得拉日茨基的心理学法学,犯罪心理学也迅速发展起来,同时有小部分心理学家坚守于证人证言的心理学研究,并产出了许多优秀成果。随着心理学与法学交叉研究的增多,有学者也将目光转向司法决策方面。心理学视域下的法学研究开拓了法学研究的新思路,不论是在理论还是实践方面都具有十分重要的意义,具有可行性与必要性。

There are many interdisciplinary researches on law and psychology,but there are not many.In the past two hundred years,the cross research between the two has experienced a low tide and a reconciliation.During this period,Petrazky’s Psychology and law came into being,and criminal psychology has developed rapidly.At the same time,a small number of psychologists stick to the psychological research of witness testimony,and have produced many outstanding achievements.With the increase of cross research between psychology and law,some scholars also turn their attention to justice decision making.The study of law from the perspective of psychology has opened up a new way of thinking in the study of law,which is of great significance both in theory and practice,and is feasible and necessary.
