新时期“天价彩礼”的形成原因与应对之策——以陇东地区田野调查为例

Reasons for“Heavy Lottery Gift”and the Countermeasures in the New Period——A Case Study on Field Investigation in Longdong Area

2019年中央一号文件首次提到“天价彩礼”现象。基于陇东地区的社会调研,阐述了近年来彩礼畸变之恶、彩礼返还之祸,并对其从法律属性的界定、立法态度的变迁、学理解释的多元三个方面进行了综述,对“天价彩礼”的成因给出了经济与人口学、法律与社会学、文化与心理学解释,并提出通过法治、德治、自治的有机结合对此进行治理的方案。

The“Village Revitalization Strategy”of 2018 calls for curbing“Heavy Lottery Gift”.Through social investigation in the eastern part of Gansu Province,this paper describes the consequences of the soaring bride price in recent years and the disputes caused by the return of bride price.At the same time,we tried to find out the causes of the formation of“Heavy Lottery Gift”,such as economic and demographic reasons,legal and social reasons,cultural and psychological reasons.This paper suggests that the"high-value bride price"should be governed by the methods of rule of law,rule of virtue and autonomy.
