摘要
制度反腐是反腐治权的根本措施,坚持制度反腐源自于制度的功能特质和优势,制度功能的重要性决定了制度反腐的重要性,有效发挥制度的功能是坚持制度反腐前提和基础。制度具有界定功能,能够辨识腐败行为;制度具有规范功能,能够规制腐败行为;制度具有稳定功能,能够维护反腐常态;制度具有保护功能,能够保障反腐权利;制度具有激励功能,能够激发反腐动力;制度具有惩戒功能,能够惩治腐败行为。理解和阐释制度的功能,对于推进我国腐败治理体系和治理能力的现代化具有重要意义。
Institutional anti-corruption is the fundamental measure to fight against corruption.Insisting on institutional anti-corruption comes from the functional characteristics and advantages of the system.The importance of institutional function determines the importance of institutional anti-corruption.To effectively play the function of the system is the premise and basis of insisting on institutional anti-corruption.The system has the function of defining and identifying corruption;the system has the function of standardizing and regulating corruption;the system has the function of stabilizing and maintaining the normal state of anti-corruption;the system has the function of protecting and protects the right of anti-corruption;the system has the function of encouraging and motivating anti-corruption;the system has the function of punishing and punishes corruption.It is of great significance to understand and explain the function of the system for promoting the modernization of China’s corruption governance system and governance capability.
