网络隐私权法律保护的缺失与对策研究

Research on the lack of legal protection of network privacy rights and countermeasures

针对目前中国的司法体系对网络隐私权保护存在的立法规定不足、公民维权艰难、缺乏有效行业监督等问题,通过对网络隐私权侵权现象的成因分析,阐明当前网络隐私权保护的主要困境,并厘清网络隐私权与传统隐私权及个人信息安全之间的法律联系,提出合理化立法建议。

In view of the present China’s judicial system of network privacy protection such as insufficient legislation,difficulty in safeguarding civil rights,lack of effective industry supervision,through analyzing the cause of the phenomenon of network privacy infringement,this paper expounds the main difficulties of network privacy protection,and clarifies the legal relationship between network right of privacy,traditional right of privacy and personal information security,and puts forward rational suggestions to improve the construction of legal system.
