民用航空领域行政犯之教义学分析

On Legal Dogmatics of the Administrative Offences in Civil Aviation

民用航空领域行政犯是伴随现代民用航空领域风险而产生的一类犯罪,其兼具行政违法性和刑事违法性。民用航空领域行政犯专属于特定领域类型化犯罪,需要引入具有教义学方法导向的刑法学知识体系进行阐释。区别于犯罪概念,行政犯概念应当较之更为延展,因此,运用关系刑法论重构行政刑法的概念,并以此为基点,拓展行政犯概念,进而扩张民用航空领域行政犯概念。我国有关民用航空领域行政刑法主要包括刑法典、具有行政性质的附属刑法以及规定有行政性刑事违法行为的相关行政法律法规,这些行政刑法中的民用航空领域行政犯具体包括民用航空领域行政犯罪和行政性刑事违法行为两大类。为了进一步认识民用航空领域行政犯,有必要对其前置性规范与罪状、违法性、违法性认识等问题展开深刻解读。

The administrative offences in civil aviation is a kind of crime which is produced to deal withrisks in modern civil aviation,having the properties of administrative and criminal illegality.Foritrefers toa category of specificoffences in a certainline,the offences can be interpreted by the principles of criminal jurisprudence with the legal dogmatics-oriented methods.Different from the concept ofcrime,the variation of administrative offense should be further expanded.So the theory of relational criminal law is used to reconstruct the administrative criminal laws,which can enlarge the content of administrative offensesin civil aviation.In China,administrative criminal lawsconcerning civil aviation mainly are theCriminal Code,subsidiary criminal law with administrative property and relevant laws and regulations stipulatingadministrative criminal offense.There are two major categories of administrative crimes and administrative criminal transgression according to the relevant laws about civil aviation.In order to get further understanding of the administrative offenses,the paper will deeply interpret the prepositive norms and indictment,illegality and illegal cognitionof the administrative offenses in civil aviation.
