我国网约车监管制度对策研究

On Countermeasures of China’s Online Car-hailing Regulation System

为了全方位保障乘车人和驾驶员的合法权益,督促网约车平台企业加强自身监管,推动网约车可持续发展,推进出租汽车市场融合发展,更好的发挥政府监管职能,为网约车相关政策制定提供技术支持,本文从网约车市场、网约车运营主体、网约车运营车辆和驾驶员三个维度,梳理网约车发展现状和存在的问题,从平台管理、驾驶员管理、车辆管理、运营服务方面,梳理网约车监管现状和存在的问题,在分析我国网约车发展现状和网约车监管制度现状的基础上,针对网约车运营中存在的不良现象和现有网约车监管制度存在的问题,提出网约车监管制度完善建议.

In order to protect the legitimate rights and interests of passengers and drivers,supervise the online car-hailing enterprises to strengthen the supervision,promote the sustainable development of online car-hailing,promote the integration of the taxi market,provide technical support for policy development related to car-hailing,the development status and existing problems of the online car-hailing are reviewed from the market,the main baby,the vehicle and the driver.The status quo and problems of online car-hailing supervision are reviewed from the platform management,driver m anagem ent,vehicle management and operation services.By analysing the status quo and regulation system of online car-hailing,the paper puts forwards some recommendations on improving the regulation system of online car-hailing in view of the unhealthy phenomena in the operation and the problems existing in the regulation system.
