Thoughts on Dealing with Contract Breach during the Novel Coronavius Epidemic Situation

受“新冠肺炎疫情”的影响,一些合同在履行中出现违约。对此,从《民法总则》《合同法》关于不可抗力作为免责条款的相关规定到目前对“新冠肺炎疫情”认定的权威观点以及如何正确理解、适用免责条款等问题进行梳理和思考,提出应对本次疫情中合同违约问题的建议。

Affected by the"Novel Coronavius Epidemic Situation",some contracts defaulted in performance.In this regard,this article reviews and considers the relevant provisions of the General Principles of Civil Law and the Contract Law on force majeure as exemption clauses,the current views of authority on the identification of the"Novel Coronavius Epidemic Situation",and how to properly comprehend and apply the exemption clauses,and puts forward suggestions to deal with the contract breach in this epidemic.
