我国反垄断绿色豁免制度浅析——以欧盟DSD案为视角

Brief Analysis of the Antitrust Green Exemption System in China——From the Perspective of EU DSD Case

随着经济的不断发展,环境污染也愈发严重,保护环境刻不容缓。反垄断法作为规制市场竞争促进经济增长的基本法,理应将环境因素纳入考虑范围之内。一些对环境有利的行为即使限制了竞争,触犯了竞争法,但基于环境保护的角度应当考虑对其予以豁免。企业间建立环境协议是保护环境的重要方式,但同时也会限制竞争,是否对其豁免是反垄断绿色豁免制度中的重要问题。文章将从此角度来分析我国反垄断绿色豁免制度的建立与完善。

With the continuous development of the economy,environmental pollution has become more and more serious.Protection of the environment should be brooked no delay.As the basic law regulating market competition and promoting economic growth,the anti-monopoly law should take environmental factors into consideration.Some environmentally beneficial behaviors,even if they limit the competition and violate the competition law,should be exempted from the perspective of environmental protection.Establishing an environmental agreement between enterprises is an important way to protect the environment,but it also limits the competition.Whether it is exempted or not is an important issue in the anti-monopoly green exemption system.From this perspective,the paper analyzes the establishment and improvement of anti-monopoly green exemption system in China.
