论我国公平竞争审查制度实施及完善

Implementation and Improvement of China’s Fair Competition Censorship

随着竞争政策在我国的基础性地位的确立,在市场体系建设中建立公平竞争审查制度有助于从源头上厘清市场和政府的关系。基于我国确立的公平竞争审查制度,分析了构建公平竞争审查制度的顶层设计思路和实施机制,提出应从进一步加强竞争执法机构的执法监督和审查指导,采用“内部评估”和“外部评估”相结合的制度模式,国务院与省级人民政府签订“执行公平竞争审查与评估制度协议”,并将其纳入干部政绩考核指标体系的建议。

With competition policy obtaining fundamental status in China’s administrative system,establishing a fair competition censorship in the construction of market system can help to clarify the basic relationship between market and the government.Based on the fair competition censorship established in China,this paper analyzes the top-level design ideas and implementation mechanism for constructing a fair competition censorship,and proposes to further strengthen the law enforcement supervision and review guidance from competition law enforcement agencies.By adopting the review model combining“internal assessment”and“external assessment”,the State Council could sign an agreement with the provincial governments to implement the“Fair Competition Review and Evaluation System Agreement”and incorporate it into the performance evaluation indicator system for government officials.
