司法鉴定郑重陈述承诺制度研究

Research on the system of judicial appraisal affirmation

证人、鉴定人出庭作证时宣誓或者郑重陈述有着悠久的历史。我国历史上有盟誓的礼仪,在古代司法上有仵作检案甘结、具结制度。在域外国家和地区,鉴定人出庭质证是否宣誓或者郑重陈述已经成为判断鉴定意见可采性的要件。最高人民法院近期出台的司法解释中首次规定了司法鉴定郑重陈述承诺制度,进一步完善了我国司法审判中对鉴定意见的科学性、公正性审查。笔者针对如何尽快落实我国司法鉴定郑重陈述承诺制度,提出了相应的建议。

Witnesses and appraisers have a long history of taking oaths or affirmation when they testify in court.In ancient China,there wererituals of alliance pledges;and in ancient justice,there was a system of recognizance for forensic experts.In many foreign jurisdictions,whether or not the appraiser appearing in the court for cross-examination to take an oath or affirm has become an element for judging the admissibility of the expert testimony.In the judicial interpretation recently issued by the Supreme People's Court,the system of judicial appraisal affirmation was first proposed,which further strengthened the scientific and fair review for expert testimony in judicial trials in China.This paper puts forward corresponding suggestions of how to implement the system of judicial appraisal affirmation in China as soon as possible.
