打击预防电信网络诈骗犯罪的资金流研究——基于“理性选择理论”视角的资金流分析

Research on the Fund Flow in the Crackdown and Prevention of the Crime of Telecom Network Fraud——Analysis of Fund Flow from the Perspective of Rational Choice Theory

随着社会科技水平的不断发展提升,金融科技化程度持续加强,金融支付领域发生了巨大变化,线下现金支付模式已逐渐过渡到"线上+线下"的融合支付模式。随着各类新支付渠道的传播与普及,电信网络诈骗犯罪也发生了一些新变化。在此以"互联网+"背景下的电信网络诈骗犯罪资金流为切入点,以全景视角分析电信网络诈骗犯罪的新特征,并以犯罪学"理性选择理论"为学术视角,尝试对电信网络诈骗犯罪中犯罪成本、犯罪收益、犯罪风险三要素进行理论探析,最后提出打击防范电信网络诈骗犯罪资金流层面的对策。

With the continuous development of social science and technology,the degree of financial technology has continued to strengthen,and the financial payment field has undergone tremendous changes.The offline cash payment model has gradually converted to the“online+offline”integrated payment model.With the spread and popularity of various new payment channels,telecom network fraud crimes have also ushered in some new changes.This paper takes the telecom network fraud criminal fund flow under the background of"Internet+"as the starting point,analyzes the new characteristics of telecommunication network fraud crime from a panoramic perspective,and attempts to approach the telecom network with the criminological"rational choice theory"as the academic perspective.The three elements of crime cost,crime income and crime risk in crimes are analyzed theoretically.Finally,countermeasures against the fund flow level of telecommunication network fraud crimes are proposed.
