摘要
信息化办公已经成为当前劳动者的主要办公方式之一,其即时沟通的特点使得劳动者工作效率显著提高,但模糊了办公场所与非办公场所、工作时间与休息时间的界限,导致劳动者休息权被侵犯的情况时有发生,甚至造成过度劳动等问题。研究分析了离线权保护的必要性和紧迫性,并结合国外离线权的发展与适用,具体阐释了离线权的法律内涵,进而为我国建立离线权法律制度提出相关建议。
Information office has become one of the main working methods for current workers. Its characteristics of instant communication has significantly improved workers’ work efficiency, but also blurred the boundary between office and non-office places, and that between working hours and rest hours. This feature often leads to frequent disturbance of workers’ rest time, and even causes problems such as overwork. This study analyzed the necessity and urgency of the offline rights. At the same time, combined with the development and application of offline rights abroad, this study also explained the legal connotations of offline rights, and put forward suggestions for establishing a legal system for offline rights in China.
