河道非法采砂中行政罚款数额的确定思路

The Determination of the Amount of Administrative Fine in Illegal Sand Mining in River Course

目前河道非法采砂中行政罚款偏重经济效益的警示和惩罚,忽视河道砂石的生态价值,没有将生态保护作为补偿因素考虑进行政处罚的标准范围内。针对以上问题,通过加大行政处罚力度,将罚款数额同违法所得挂钩,同时河道生态环境遭到破坏的并处罚款作为河道生态补偿专项资金,建立河道砂石生态补偿制度等措施以规范河道采砂行为,推动行政执法工作。

At present,the administrative fines in illegal sand mining in river course emphasizes the warning and punishment of economic benefit,ignore the ecological value of river sand and stone,ecological protection is not considered as a compensation factor in the standard scope of administrative penalty.In respect of the problems above,by increasing the intensity of administrative penalties,the amount of fines be linked to the illegal income,at the same time,if the ecological environment of the river is damaged,the fine shall be used as the special fund for compensation of the ecological environment of the river,establish the sand and gravel ecological compensation system and other measures to regulate the river sand mining behavior,promote the work of administrative law enforcement.
