由于走不出事实与价值的迷宫,菲尼斯想在20世纪重振自然法的努力陷入了难以自拔的理论困境。他不仅将工具性的实践理性等同于目的性的道德价值,而且还把某种特定的规范性信仰说成是对于所有人都适用的普遍行为原则,结果暴露了西方自然法理论其实并不自然的致命伤。
John Finnis hopes to revive natural law in the 20 th century, and yet his endeavor falls into a theoretical dilemma because he is unable to walk out of the maze of fact and value. His theory not only equates the instrument of practical reason with the aim of moral values, but also describes a specific normative belief as a universal principle applicable to all people, and thereby exposes the fatal defect of Western tradition of natural law as an unnatural theory.
