摘要
除去传统意义上典型的全日制用工劳动关系,非典型劳动关系中的非全日制用工在目前劳动市场中占据了一席之地。非全日制用工的灵活性对于促进适龄劳动者就业起到了重要作用,但是非全日制劳动者在劳动报酬、劳动合同的形式、劳动时间以及用工制度的转换等方面受到的法律保护却不甚如意,规定非全日制加班制度,统一最低小时工资标准,利用书面合同形式稳定非全日制劳动关系,为非全日制劳动者购买劳动保险,保障劳动者权益,以此促进非全日制用工制度的完善势在必行。
Apart from the typical labor relationship of full-time employment in the traditional sense,parttime employment in the atypical labor relationship occupies a place in the current labor market.The flexibility of part-time labor employment plays an important role in promoting the employment of rightage workers.However,the protection of the part-time labors from laws is not as well as expected in labor remuneration,forms of labor contract,labor time and the transition of employment system.To regulate the overtime system of part-time employment,unify the standard of minimum wage per hour,stabilize part-time labor relationship by using the form of written contracts,buy labor contracts for parttime labors and protect the rights of labors so that the perfection of part-time employment system can be promoted.
