摘要
田湾核电站3、4号机组外供设备合同中,外方负责核岛重要设备供货,主设备能否按期保质供货是工程顺利安装的前提,是项目顺利进行的关键因素。为保证工程进度,确保设备顺利供货,合同中设置了延迟交货违约罚款,并通过索赔机制加强管控力度。通过建立索赔数据库、健全索赔台账、搜集索赔证据、梳理索赔难点、建立多部门联动、索赔谈判等策略,成功保证了设备的供货,并在实践中探索出一系列行之有效的合同索赔管理措施。
In the contract of Tianwan 3&4,the foreign party is responsible for the supply of important equipment of NI.Delivery on time with good quality is the premise for the installation of the project and the key factor of project progress.In order to ensure the supply of equipment,the contract sets claims for liquidated damages on equipment delivery delay,and strengthens the control through the claim mechanism.By establishing claim database,perfecting claim ledger,collecting claim evidence,sorting out difficulties of claim,establishing multi-department linkage,claim negotiation and other strategies,the equipment supply was successfully guaranteed,and a series of effective measures are found for the contract claim management in practice.
