From Rule System to Rule of Law System:the Epistemological Approach of University Governance System with Chinese Characteristics

中国特色大学治理规则体系业已形成,它是我国现代大学制度建设取得的重要成就,为大学的改革与发展奠定了重要的、坚实的制度基础。但是,其形成过程中偏重以成文规则确定治理结构的建构理性主义路径不再适合未来我国大学治理法治体系的形成,完善大学治理体系需要转向进化理性主义思路。中共十五大到十九大报告中有关立法、执法、司法和守法叙述的内在逻辑为未来中国大学治理法治体系形成提供了框架与路径。

The rule system of university governance with Chinese characteristics has taken form.This is a major achievement in building China’s modern university system and lays an important and solid institutional foundation for the reform and development of colleges and universities.However,the forming of the system tends to stress constructive rationalism which defines the governance structure by written rules.This approach is no longer suitable for establishing a rule of law system for China’s future university governance.Instead,to improve the governance system,it is necessary to turn to the evolutionary rationalistic approach.In the reports delivered at the 15th to 19th CPC national congresses,the internal logic of accounts concerning legislation,law enforcement,justice and law abiding have provided a framework and approach for establishing a rule of law system for the governance of Chinese universities.
