高校法律援助制度:从脱条例化到立法回归

Legal Aid System in Colleges and Universities:From Deregulation to Legislative Return

高校法律援助是法律援助体系的重要组成部分,但现行的《法律援助条例》对高校法律援助的规定尚处于空白状态,高校法学专业学生参与法律援助呈现出“脱条例化”的现象,致使高校法律援助地位尴尬、权利行使受阻、援助质量大打折扣。高校法学专业学生参与法律援助,既是高校培养高素质法治人才的必要通道,也是社会上弱势群体权利保障的有益通道,有其正当性基础。为有效盘活高校法律资源,提高国家治理的法治化水平,解决当下高校法律援助“脱条例化”的困境,需要推动高校法律援助制度“入法化”,需要将高校法律援助纳入到《法律援助法》的修订之中,使得高校法律援助有法可依。同时,注重对高校法律援助制度的细节性立法表达,进一步健全程序配套机制,构建科学的高校法律援助实施体系、高质量的高校法律援助监督体系以及强有力的高校法律援助保障体系。

Legal aid in colleges and universities is an important part of the legal aid system,but the current regulations on legal aid in colleges and universities are still in a blank state.The participation of law students in legal aid in colleges and universities shows the phenomenon of"deregulation",which makes the status of legal aid in colleges and universities awkward,the exercise of rights blocked,and the quality of aid greatly reduced.The participation of law major students in legal aid is not only a necessary channel for colleges and universities to cultivate high-quality legal talents,but also a beneficial channel for the protection of the rights of vulnerable groups in society,which has its legitimacy basis.In order to effectively activate the legal resources of colleges and universities,improve the level of rule of law in national governance,and solve the dilemma of"deregulation"of legal aid in colleges and universities,we need to promote the"legalization"of the legal aid system in colleges and universities,and we need to incorporate the legal aid in colleges and universities into the revision of the legal aid law,so that the legal aid in colleges and universities can be relied on.At the same time,we should pay attention to the detailed legislative expression of the legal aid system in colleges and universities,further improve the supporting mechanism of procedures,and build a scientific implementation system of legal aid in colleges and universities,a high-quality supervision system of legal aid in colleges and universities,and a strong guarantee system of legal aid in colleges and universities.
