摘要
在“一府一委两院”宪制架构的基础上,贯彻落实地方监察委员会对同级人大负责的宪法规定,建构符合地方人大属性的监督模式,是推进法治反腐全面深化,实现“对监督权的再监督”的必要保障。从本质上看,地方人大对“权”的监督与地方监察委员会对“人”的监督之间并不存在冲突,两者具有互补性。将地方人大对地方监察委员会的监督纳入整个法治监督体系之中,有助于解决地方监察委员会作为“监督者难以监督自身”的问题,克服扁平化监察监督权的“内在贫困性”。要改变地方人大监督“柔性有余而刚性不足”的状况,就必须将刚性监督工作提至幕前,通过充分发挥其全过程性监督职能以及重启刚性问责监督职能,保障再监督的实效性。
On the basis of the constitutional structure of“the Government,the Supervision Committee,the Court and the Procuratorate”,to implement the constitutional stipulation that the local supervisory committee members should be responsible to the people's congress at the same level,and to construct a supervisory model which conforms to the attributes of local peoples congress,constitute an necessary guarantee to promoting the rule of law,comprehensively deepening anti-corrupting and realizing the“re-supervision of supervisory power”.In essence,there is no conflict between the supervision of“power”by local peoples congress and that of“person”by local supervisory committee,and actually these two aspects are complementary.The incorporation of local peoples congress supervision over local supervisory committee into the whole supervisory system will help overcome the drawbacks of local supervisory committee as“supervisors are difficult to supervise themselves”and make up for the“inherent poverty”of supervisory power.In order to change the situation that the local people's congress supervision is“flexible but not rigid enough”,we need to make the supervisory work more visible,find out and deal with the problems existing in the operation of supervisory power in time through all-round process supervision and rigid accountability methods,so as to enhance the effectiveness of supervision.
