摘要
在犯罪行为非犯罪化的方向下,拒不支付劳动报酬行为入刑的合理性存在质疑。以刑法规制拒不支付劳动报酬行为,存在立法基础不合理,实施难度大,实行效果不力的缺陷。针对此现象,应当贯彻行政、民事路径,完善工资基金保障制度,必要时可扩大拒不支付判决、裁定罪的适用范围以求实现恶意欠薪行为的去犯罪化,保护劳动者的财产权益,缓解劳资纠纷。
In the direction of decriminalization of criminal acts,there are doubts about the rationality of refusing to pay labor remuneration into punishment.In order to regulate the behavior of refusing to pay labor remuneration by criminal law,there are some defects,such as unreasonable legislative basis,difficult implementation and ineffective implementation.In view of this phenomenon,we should implement the administrative and civil approaches,improve the wage fund security system,and expand the scope of application of the crime of refusing to pay judgment and ruling when necessary,so as to realize the decriminalization of malicious wage arrears,protect the property rights and interests of workers,and ease labor disputes.
