关于构建罪错未成年人分级管理机制的思考

Thoughts on Constructing Level-to-level Administration Mechanism for Delinquent Juveniles

近年来,罪错未成年人的处遇问题受到社会各界的广泛关注。面对相关规定过于原则、监督制约机制不足、矫治帮教工作缺乏针对性和有效性等问题,应秉承"教育、感化、挽救"的方针,坚持"教育为主、惩罚为辅"的原则和"提前干预,以教代刑"的特点,以"强调恢复、积极预防"为目标,按照主体年龄分级、适用行为分级、措施类型分级,构建精准多元有效的阶梯式罪错未成年人分级管理机制,从源头上预防和减少未成年人犯罪。

In recent years,the problem of juvenile delinquency has drawn wide public attention.Facing such problems of principled relevant provision,insufficient restriction mechanism and lack of pertinence and effectiveness in correcting juvenile delinquents,this paper suggests adhere to the policy of"education,influence in emotion and transformation",the principle of"giving education priority while taking punishment as complementary method"and the characteristics of"early intervention and replacing punishment with education"with the purpose of"paying more attention to mending the wrongdoings and active prevention",and construct targeted,multilateral,effective,multi-layered and level-to-level administration mechanism for delinquent juveniles according to age,wrongdoing and measure grading of subjects,so as to prevent and reduce minor crimes.
