大学章程在高职院校内部治理中的关系与作用研究

Research on Relationship and Function of University Constitution in Internal Governance for Higher Vocational Colleges

大学章程是高校组织和行为的准则,其内涵必然要体现高校的治理制度,明确利益相关者的权责边界。大学章程是由高校的举办者和经营者制定的,并对高校及其经营者等利害关系人具有约束力的,调整高校内部组织关系和经营行为的自治规则。在高职院校内部治理过程中,章程的形成过程体现着法定性、自治性、公开性,其内容则同样彰显着应有的法义,发挥着法定性、自治性、公开性等方面的作用,使院校的运行建立在管办明晰、权责明确、利益协调的基础上,进而促进整个高教事业的快速发展。

University constitution is the criterion of organization and behavior, whose connotation must embody the governance system of colleges and universities, and make clear the boundary of stakeholders’ power and responsibility. The university constitution is formulated by the organizers and operators of colleges and universities, binding on the interested parties such as universities and their operators, which are autonomous rules for adjusting the internal organizational relations and business behaviors of colleges and universities. In the process of internal governance in higher vocational colleges, the formation process of constitution embodies legality, autonomy and openness, whose content also shows the due legal meaning, playing the role of legality, autonomy, openness and so on, so that the operation of colleges and universities is based on clear management, clear powers and responsibilities, as well as coordinated interests, in order to promote the rapid development of the whole higher education.
