通常技术在成为标准之前,一般并不是必不可少的,但一旦技术被纳为标准,就可能会成为某个行业的标准,称为标准必要专利。为了遏制标准必要专利赋予专利权人的“垄断力量”,大多数标准化组织要求标准必要专利持有人做出一定承诺,即以合理的条件许可他人使用其专利。这对专利持有人的权利进行限制,同时也产生了更多的诉讼案件。所以如何在维护标准必要专利权人的正当权益的条件下,坚持技术标准专利的开放性,就成为反垄断法和知识产权法交叉的一个重要问题。

Generally,technology is not necessary before it becomes a standard,but once it is accepted as a standard,it will become a standard of an industry,which is called standard essential patent.In order to curb the"monopoly power"that standard essential patents give to patentees,most standardization organizations require the holders of standard essential patents to make certain commitments,that is,to license others to use their patents under reasonable conditions.This has limited the rights of patent holders,and at the same time,more lawsuits have been brought about.Therefore,how to maintain the legitimate rights and interests of the patentees who are necessary for standards,and how to adhere to the openness of technology standard patents,has become an important issue between anti-monopoly law and intellectual property law.
