An Investigation into the Model Cases of the Procuratorial Supervision over Civil Proceedings

办理引领性案件是最高人民检察院对民事诉讼检察监督提出的新要求。引领性案件与指导性案例、类案之间存在一定联系,但又具有不同于这两类案件的自身特征。引领性案件具有一定的稀缺性,检察环节中的引领性案件更是一种稀缺资源。引领性案件可区分为高端与普通两种。检视最高人民检察院、最高人民法院的指导性案例,剖析每年评选出来的影响性案件、典型案件是发现引领性案件的有效途径。

To successfully handle a series of model cases is a new requirement proposed by the Supreme People’s Procuratorate for the implementation of procuratorial supervision.The model cases are closely related to the guiding cases and the cases belonging to the same category but distinctively differ from the latter two types of cases.One of the features of model cases is their scarcity and in the procuratorial process it is even more difficult to get access to the cases of this type.The model cases can be classified into two sub-types:the high-end cases and the common cases.An effective approach to the establishment of such cases is to examine the guiding cases issued by the Supreme People’s Procuratorate and the Supreme People’s Court and to analyze the influential and typical cases identified and selected annually.
