非法生产、进口和出口水产苗种的法律责任及其完善

Legal Liability and Improvement of Illegal Production,Import and Export of Aquatic Seeds

为促进我国水产养殖业和水产品贸易的发展,文章梳理我国关于生产、进口和出口水产苗种的相关规定,分析对非法生产、进口和出口水产苗种进行处罚的原因和力度,并提出建议。研究结果表明:水产苗种是重要的渔业资源,具有自身特点和内在规律,我国以法律形式对生产、进口和出口水产苗种进行规定;我国对非法生产、进口和出口水产苗种进行处罚的法律规定较宽泛,建议以法律形式完善水产苗种检疫体系、完善水产苗种许可制度以及规定从轻或减轻处罚条款。

In order to promote the development of China′s aquaculture industry and aquatic products trade,the paper reviewed China′s laws and regulations on the production,import and export of aquatic seed,analyzed the reasons and intensity of penalties for illegal production,import and export of aquatic seed,and made recommendations.The research results showed that aquatic seed was an important fishery resource with its own characteristics and inherent laws.China has regulated the production,import,and export of aquatic seed in legal form,and the illegal production,import,and export of aquatic seed has been penalized.The legal provisions are relatively broad,and it is recommended that the aquatic seed quarantine system,the aquatic seed licensing system,and the provision of lighter or lighter penalties should be improved in legal form.
