摘要
在数字经济条件下,算法不仅加剧了传统的寡头垄断问题,而且简化了共同市场支配地位的构成要件。因此,将共同市场支配地位制度拓展适用于算法默示共谋具有必要性和可行性。该制度能够预防共同市场支配地位的形成,破解认定垄断协议在证明要求上的障碍,制止卡特尔的"第二阶段行为",具有难以替代的制度价值。我国应适时修改《反垄断法》第19条关于推定共同市场支配地位相关规定的不足。
Under the condition of the digital economy, the algorithm intensifies the traditional oligopoly problem and simplifies the constitutive elements of collective dominance. Therefore, it is necessary and feasible to apply the institution of collective dominance to the tacit algorithmic collusion. Meanwhile, the institution can prevent the formation of collective dominance, overcome the obstacles of proof in the determination of monopoly agreement, restrict the cartel’s second-stage conducts, thus has irreplaceable institutional value. China should timely amend the deficiencies of article 19 of the Anti-Monopoly Law on the presumption of collective dominance.
