历史建筑保护与私人产权的张力与协调——以丽水市松阳县的实践调研为例

Tension and coordination between protection of historical buildings and private property rights:taking practice and investigation tour in Songyang County,Lishui City

产权制度是一项基础性的经济制度,现实中历史建筑模糊的产权权利细分和失衡的产权结构安排是掣肘其保护的根本因素之一。经历多次政策调整后,这种现象在私人共有产权中尤为突出。本文基于丽水松阳县对历史建筑保护的实践探索,进行剖析、归纳,总结并评述其在平衡公益与私益,打破产权流转的框架性死局中的两大模式。

The property right system is a basic economic system.In reality,the fuzzy subdivision of the property right and the unbalanced property right structure arrangement of the historical building are the fundamental factors that restrict its protection.After many adjustments of policy,this phenomenon is particularly prominent in private shared property rights.Based on the practical exploration of historical building protection in Songyang County,Lishui,this paper analyzes,sums up,summarizes and comments on its two models in balancing public welfare and private interests and breaking the framework of property right circulation.
