我国海洋生态补偿法律制度构建研究

Research on the Construction of Marine Ecological Compensation Legal System in China

与国外的海洋生态补偿制度实践相比,我国在立法、各要素明晰以及相关配套制度完善等方面仍存在缺陷。为了贯彻落实党的十九大报告中对海洋生态文明建设的要求,我国应借鉴国外有益经验,探索适合我国的立法模式,并在立法内容以及相关配套制度的搭建上做出相应的完善,积极推动海洋生态补偿制度的构建。

Compared with the practice of the marine ecological compensation system abroad China has still defects in legislation,elements and related supporting systems.In order to implement the requirements for the construction of the marine ecological civilization in the report of the 19th National Congress of the Communist Party of China,China should learn from foreign beneficial experiences,to explore the legislative models suitable for China,to make corresponding improvements in the legislative content and the construction of relevant supporting systems,and to actively promote the construction of marine ecological compensation system.
