以一杆不规范的秤为缘起,引证国内外相关文献,逐步展开和剖析中国传统商业社会缺乏规范与法理的实况与原因;努力结合中西哲学、经济学相关原理与方法,深入挖掘商规与法理背后"基础性操作"作用的文化因素与思维方式,特别强调中西在形成不同的行为、制度等方面根本精神的差异及作用机制的不同。

Starting from a non-standard scale,this paper cites relevant literature at home and abroad,and gradually analyzes the fact and cause of the lack of norms and legal principles in traditional Chinese commercial society.Based on the relevant principles and methods of Chinese and western philosophy and economics,this paper deeply explores the cultural factors and ways of thinking of the"basic operation"behind the business rules and legal principles,especially emphasizes the differences in the fundamental spirit and mechanism of the formation of different behaviors and systems between China and the West.
